These Terms and Conditions ("Terms") govern your access to and use of the IndustraX Heavy Industries Ltd. website (the "Site") and any related services provided by IndustraX ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or our services.

The INDUSTRAX name and logo are registered trademarks of IndustraX Heavy Industries Ltd. All other trademarks, service marks, and trade names appearing on the Site are the property of their respective owners.

IndustraX makes no representations or warranties of any kind, express or implied, regarding the operation of the Site or the accuracy, completeness, or reliability of the content. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall IndustraX, its directors, officers, employees, or agents be liable for any indirect, consequential, special, incidental, or punitive damages arising out of or in connection with your use of the Site or these Terms, whether based on contract, tort, strict liability, or otherwise. Our total liability to you for any claims arising under these Terms shall not exceed the amount paid by you, if any, to IndustraX for access to or use of the Site during the twelve months preceding the claim.
You agree to defend, indemnify, and hold harmless IndustraX and its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Site.
We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any reason, including if we reasonably believe that you have violated these Terms. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of such courts.
We may modify these Terms at any time. The revised version will be effective as of the "Last updated" date indicated at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the new Terms. If you do not agree with the revised Terms, you must discontinue use of the Site immediately.
